  • Among the cases reported in Volume 119 are Pinochet decisions from English, Spanish, Belgian, and Luxembourg courts. The volume also includes an important ICSID arbitral award in Metalclad (and British Columbia decision), and the arbitration tribunal maritime delimitation Phase Two of the Eritrea/Yemen dispute. Finally, Volume 119 reports the Southern Bluefin Tuna (Australia and New Zealand v. Japan) arbitration tribunal award of August 2000.

    • Pinochet decisions: Relating to criminal proceedings against General Augustus Pinochet. In the English courts, question whether Pinochet, as a former Head of State of Chile, was entitled to State immunity as the charges against him concerned acts which he was alleged to have performed as Head of State.
    • Arbitral Award in Metalclad: The arbitration tribunal found that Mexico had violated the provisions of NAFA in the treatment accorded to Metalclad, a US investor. The Supreme Court of British Columbia set aside the award in part.
    • Southern Bluefin Tuna Case (Australia and New Zealand v. Japan): Found that the Tribunal lacked jurisdiction, revoking the Order prescribing provisional measures (reported in 117 ILR 148).
